These Terms of Service ("Terms") govern your access to and use of dreamhomeny.com (the "Site") and all purchases made from DHE MARKETING LLC, doing business as Dream Home NY ("we," "us," or "our").

By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, Return Policy, and Shipping Policy, which are incorporated herein by reference. If you do not agree to these Terms, do not use the Site.

1. Account Creation and Security

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate accounts at our sole discretion.

2. Orders and Acceptance

  • Offer to Purchase: Placing an order constitutes an offer to purchase products under these Terms.
  • Acceptance: Orders are subject to our acceptance. We reserve the right to refuse, limit, or cancel any order at any time for reasons including, but not limited to, inventory shortages, errors in product or pricing information, or suspected fraudulent activity.
  • Refunds on Cancellation: If we cancel an order after your payment method has been charged, we will issue a full refund to the original payment method.

3. Prices, Taxes, and Payment

  • Pricing: All prices are displayed in U.S. Dollars ($) and are subject to change without notice prior to order placement.
  • Taxes: Applicable sales tax will be calculated and added to your order total at checkout based on the shipping destination, in accordance with applicable state and local law.
  • Payment: Payment is charged at the time your order is placed. You represent and warrant that you are authorized to use the designated payment method.

We strive to display the colors, textures, and features of our products as accurately as possible. However, actual colors and details depend on your device display settings, and we cannot guarantee that your monitor will accurately reflect product details. 5. Shipping and Risk of Loss

  • Shipping: Shipping procedures, delivery times, and rates are governed by our Shipping Policy.
  • Risk of Loss: Except as stated in our Return Policy for damaged, defective or incorrect items, we are not liable for delays caused by the carrier.

  • Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DHE MARKETING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.
  • Liability Cap: OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE ORDER GIVING RISE TO THE CLAIM.

11. Dispute Resolution: Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

  • Mandatory Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or purchases made from us shall be resolved exclusively through final and binding individual arbitration, rather than in court. Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
  • Class Action Waiver: YOU AND DHE MARKETING LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
  • Small Claims Court Exception: Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction.

12. Governing Law and Venue

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. To the extent court proceedings are permitted under these Terms, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in New York County, New York.

13. Severability and Entire Agreement

  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
  • Entire Agreement: These Terms, together with our Privacy Policy, Return Policy, and Shipping Policy, constitute the entire agreement between you and DHE MARKETING LLC regarding your use of the Site and purchases therefrom.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. The updated version will be posted on this page with a revised "Last Updated" date. The version of the Terms in effect at the time you place an order will apply to that purchase.
